【專利】陸支付知識產權費 年增17% - 2018年06月29日

　　國務院新聞辦公室28日發佈「中國與世界貿易組織」白皮書稱，加入世貿組織（WTO）以來，中國知識產權保護效果明顯，2001年起對外支付知識產權費年均增長17%。
　　中新社報導，白皮書稱，加強知識產權保護是中國的主動作為。中國鼓勵中外企業開展正常技術交流合作，依法保護在華外資企業合法知識產權。
　　白皮書指出，中國加入WTO後建立健全知識產權法律法規，與多個國家建立知識產權工作機制，構建起符合WTO規則和中國國情的知識產權法律體系，包括修訂《商標法》，增加懲罰性賠償制度；修訂《反不正當競爭法》，進一步完善商業秘密保護等。此外，中國還持續加強知識產權保護執法力度，把違法成本顯著提上去。(聯合新聞網)...more

【專利】智慧局「生技醫化及中草藥專利檢索系統」之中草藥資料，增加資料庫格式下載服務，歡迎各界參考利用 - 2018年06月19日

一、鑑於中草藥資料對相關產業發展具有重要參考價值，本局前已於105年10月份將101年以前整備完成之部分資料整理後匯出成文字檔，並置於機關網站提供下載。

二、為提升資料加值應用之便利性，本局即日起增加SQL Server資料庫匯出之資料檔案格式 (副檔名為*.sql，含table schema及data)，歡迎自行下載利用。

【專利】中國外觀設計專利統計數據2017 ─ Nike居外商之冠 - 2018年05月17日

　　中國國家知識產權局規劃司於2018年4月公告了「外觀設計專利簡要統計數據2017」，披露了中國外觀設計專利的發展近況。統計顯示2017年中國大陸外觀設計專利申請量達62.9萬件，同比成長2.4％，但在授權量部分，則微跌0.7%，來到44.3萬件。此外，截至2017年底為止，外觀設計專利有效量總計為145.9萬件，同比成長7.4%。
　　在2017年度中，不管是申請或是授權的部分，都以中國本土企業或個人占大多數。在申請部分，中國本土達61.1萬件，占97.2%；而授權的部分，中國本土達42.6萬件，占比96.3%；有效量方面，中國本土數量為134.7萬件，占92.3%。(聯合新聞網)...more

【專利】New Guidelines on Inventive Step Examination of Invention Patent in Taiwan - 2018年05月23日

Taiwan Intellectual Property Office (TIPO) announced a new version of Section III “Inventive Step” of Chapter III “”Patentability of Part II “Substantive Examination” of “The Patent Examination Guidelines for Invention Patents”, which is briefly called as “New Examination Guidelines on Inventive Step of Invention Patent” (NEGISIP) hereinafter, and took it effective as of July 1, 2017.

The major issues of the amendment provisions comprises (1) the prerequisites for determination of inventive step, (2) the definition of a person who has general knowledge pertains to in the invention (“person skilled in the art” or “ordinary skilled person”), (3) examination principles for determination of inventive step and so on, (4) examination principles for determination of inventive step, as well as matters concerning examination on inventive step, which are briefly introduced as followings.。(APAA e-Newsletter)...more

【專利】臺日專利審查高速公路(PPH MOTTAINAI)試行計畫自106年5月1日起延長3年 - 2018年05月01日

　　臺日經貿關係向來密切，日本是外國人向我國申請發明專利最多的國家，去(105)年計申請 12,006件，而我國人向日本申請發明專利案件數亦有1,306件。為加速雙方發明專利案件審查速度，使申請人能快速取得專利，臺日自101年5月1日起開始實施專利審查高速公路(PPH)試行計畫，並於103年5月1日起修正為增強型專利審查高速公路(PPH MOTTAINAI)。
　　臺日PPH MOTTAINAI試行計畫於本年4月30日屆期，經雙方同意自106年5月1日起延長試行期間3年，以繼續提供臺日兩國申請人便捷的PPH服務。詳細申請書及作業方案請參閱智慧局網頁。(經濟部智慧財產局)...more
